Our Role as a Discovery Platform

Kikbo acts as a discovery platform, connecting you with products offered by independent third-party providers (“Third-Party Providers”). We do not create, manufacture, or own these products.

  • Third-Party Responsibility: Third-Party Providers are solely responsible for designing, producing, and ensuring the quality and safety of their products. Any product-related issues should be directed to the relevant Third-Party Provider.
  • Our Commitment to Help: While Kikbo is not legally responsible for Third-Party Providers’ products, we will assist you in resolving concerns by coordinating returns, exchanges, or refunds as needed.

2. Your Responsibilities

By using Kikbo, you agree to:

  • Comply with all applicable laws and regulations.
  • Provide accurate information if you create an account.
  • Keep your login credentials secure and notify us of any unauthorized use.

3. Age Restriction

  • You must be 18 years of age or older to use this Platform or make a purchase.
  • If you are under 18, you may only use the Platform under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

  • By submitting content (e.g., reviews, comments) to Kikbo, you grant us a non-exclusive, worldwide, royalty-free license to use, display, modify, and distribute that content.
  • You warrant that any content you submit does not infringe on any third party’s rights.

7. Disclaimers & Limitation of Liability

  • Platform Provided “As Is”: While we aim to provide reliable services, we make no guarantees that the Platform will be uninterrupted or error-free.
  • Third-Party Products: Kikbo does not produce or control the products offered by Third-Party Providers, and thus disclaims liability for their quality, safety, or performance.
  • Our Support Role: We will support you in seeking resolution when issues arise, but such assistance does not transfer legal responsibility for product issues to Kikbo.
  • Limit of Liability: To the fullest extent allowed by U.S. law, Kikbo (including our officers, employees, and affiliates) will not be liable for indirect, incidental, special, or consequential damages related to your use of the Platform or any third-party products.

8. Indemnification

You agree to defend, indemnify, and hold harmless Kikbo, our affiliates, and our employees from any claims arising out of your breach of these Terms or misuse of our Platform.

9. Termination

We reserve the right to suspend or terminate your access to our Platform at any time for any reason, including violation of these Terms.

10. Changes to These Terms

We may update these Terms at any time by posting the revised version here. The “Last Updated” date at the top indicates when changes were made. By continuing to use our Platform after changes are posted, you agree to the updated Terms.

11. Governing Law & Jurisdiction

These Terms and any disputes arising under them are governed by the laws of the United States. Any legal actions must be brought in the appropriate courts in the U.S.

12. Dispute Resolution & Arbitration

To the fullest extent permitted by applicable law, you and Kikbo agree to resolve any dispute, claim, or controversy arising from or relating to these Terms or your use of the Platform through binding arbitration on an individual basis. This includes disputes about the validity, enforceability, or interpretation of this arbitration provision.

A. Arbitration Rules & Forum

  • The arbitration shall be administered by a recognized arbitration organization (e.g., the American Arbitration Association, “AAA”) under its rules.
  • The arbitration will take place in a mutually convenient location or virtually, if the parties agree.

B. Class Action Waiver

  • You agree that any arbitration will be conducted in your individual capacity only, not as a class action or other representative proceeding.
  • You expressly waive your right to file a class action or seek relief on a class basis.

C. Exceptions

  • You or Kikbo may seek to resolve a dispute in small claims court if it qualifies.
  • Nothing in this clause prevents either party from seeking injunctive or equitable relief for claims related to intellectual property rights.

D. Opt-Out

  • If you do not wish to be bound by this arbitration provision, you must notify us in writing within 30 days of first using the Platform or making a purchase. Send your opt-out notice to support@kikbo.com with the subject line “Arbitration Opt-Out.” If you do not opt out, you will be bound by this arbitration agreement.
